Terms of Service

Welcome to BSSR Nodes. By using our services, you agree to the following Terms of Service. Please read them carefully before proceeding.

1. General Terms

By using BSSR Nodes, you agree to comply with all applicable local, international, and hosting jurisdiction laws. You are solely responsible for the content hosted on our servers and must ensure that it does not violate these Terms of Service or any relevant regulations.

2. Acceptable Use

• You may not host or distribute illegal content, including but not limited to content that infringes on copyrights, violates privacy, or is defamatory.
• You must comply with the laws of your jurisdiction, Australian law (including the Online Safety Act 2021), and German law where our servers are located.
• Unauthorized access or modification of data is prohibited under Section 478.1 of the Criminal Code Act 1995 (Cth).
• You may not use our services for WhatsApp bots or any other platform that violates their own terms. Discord bots are permitted.
• You may not use our services for spamming, phishing, malware distribution, or network disruption.
• You must not violate German laws, including but not limited to the Criminal Code (StGB), the Network Enforcement Act (NetzDG), and TTDSG. This includes a strict ban on hate speech, CSAM, extremist content, or denial of the Holocaust.

3. Prohibited Content

• Child sexual abuse material, terrorism, extreme violence, or non-consensual intimate material.
• Malware, ransomware, remote access trojans (RATs), or any similar software.
• Phishing pages or fraudulent impersonation of other platforms (e.g., fake login pages).
• Denial-of-Service (DoS) tools, booters/stressers, packet flooders, or scanners.
• Cryptocurrency mining (e.g., CPU/GPU miners) of any kind.
• Proxies, VPNs, or tunneling software used to bypass bans or abuse rate limits.
• Unauthorized reselling or subleasing of our services without express permission.
• Any activity designed to bypass platform or service rate limits or anti-abuse mechanisms.
• Content that violates the terms of services of integrated platforms (e.g., Discord, Roblox).

4. Right to Inspect and Access Your Server

BSSR Nodes reserves the right to inspect and access your hosted content and servers at any time, without prior notice, to ensure compliance with these Terms of Service. If we find that you are violating any of the terms, we may suspend your server or delete your account..

5. Account Deletion

• We may suspend or delete your account at our discretion if you violate any of the terms outlined in this document.

6. Limitation of Liability

In no event shall BSSR Nodes be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to the use of our services, even if we have been advised of the possibility of such damages.

7. Changes to the Terms of Service

BSSR Nodes reserves the right to modify or update these Terms of Service at any time. You will be notified of any significant changes, and continued use of the service after such changes indicates your acceptance of the updated terms.

9. Repeat Violations and Account Ban Policy

• If your account receives three (3) server suspensions for TOS violations, it will be permanently deleted.
• All associated servers and data will be purged without recovery.
• You will be banned from our Discord server and barred from creating new accounts.
• Attempting to bypass this restriction via alternate accounts will result in immediate enforcement.

10. Data Retention

In the event of account deletion, BSSR Nodes may retain user data for up to 7 days for internal review or legal purposes. After this period, all data will be permanently deleted. Data recovery is not guaranteed.

11. Fair Use Policy

Our services operate under a fair use principle. Excessive CPU, memory, bandwidth, or disk usage that negatively impacts server performance or other users' experience may result in throttling, suspension, or deletion without prior notice.

12. Service Availability

We strive for high uptime, but service interruptions may occur due to maintenance, technical issues, or upstream outages. We are not liable for damages caused by downtime or unavailability.

13. Compliance with German and EU Laws

As our infrastructure is hosted in Germany, all users must adhere to the legal framework established by German and European Union law. This includes but is not limited to:

• GDPR: Any personal data processed or stored must comply with the General Data Protection Regulation. Users are responsible for ensuring data subjects' rights are respected.
• NetzDG: Content violating German laws on hate speech, extremism, or misinformation will be removed and reported as required by law.
• StGB: Hosting illegal content such as CSAM, glorification of violence, incitement to hatred (§130 StGB), or Holocaust denial is strictly forbidden and will result in immediate reporting to German authorities.
• TTDSG: You may not implement unauthorized tracking, analytics, or cookies that breach the privacy protections of German users.

Violations of these laws may result in account deletion, data reporting, and permanent bans without warning.
